Firearms and Gun Offenses

California gun laws allow almost anybody to buy a firearm without a license.  Persons generally prohibited from doing so are convicted felons, persons convicted of certain misdemeanor crimes, narcotic addicts, persons suffering from mental illness, and minors.

Many California gun laws prohibit carrying firearms under certain circumstances.  Carrying or possessing an illegal firearm, or illegally carrying or possessing a legal firearm, subjects a person to substantial criminal penalties.

Illegally carrying a firearm can be quite serious but illegally using a firearm is even more so.  Each law carries its own penalties.  Some are misdemeanors while others are straight felonies.  Others are “wobblers” which mean that prosecutors can use their discretion to determine whether to charge the offense as a misdemeanor or a felony.
